Article 1 – Definitions

In these Terms and Conditions, the following definitions apply:

• Consumer: a natural person acting outside their trade or profession who enters into a distance contract with us.
• Distance contract: a contract concluded remotely between us and the consumer, without physical presence.
• Right of withdrawal: the consumer’s right to cancel a distance contract within a specified period.
• Durable medium: a way to store information so it can be accessed later unchanged (e.g., email, PDF).
• Entrepreneur: Makzy’s, the party offering products and services.
  Terms and Conditions: these General Terms and Conditions of the entrepreneur.

Article 3 – Applicability

These Terms apply to every offer and every distance contract between Makzy’s and the consumer.

Before concluding a contract, these Terms will be made available to the consumer electronically or in another suitable way. If this is not reasonably possible, the consumer will be informed where they can inspect the Terms.

In case of conflicting provisions between these Terms and any specific product conditions, the consumer may only rely on the provision most favorable to them.

If any part of these Terms is invalid or unenforceable, the remaining provisions remain fully effective.

Article 4 – The Offer

Offers are without obligation and may be altered or withdrawn by Makzy’s at any time without prior notice.

We strive to accurately represent our products and services. However, product colors and appearance may vary due to your device and settings.

We do not guarantee that products or services will meet your expectations or exactly match their online representation.

Product descriptions may change without notice. We reserve the right to discontinue products or limit quantities at our discretion.

Apparent errors or obvious mistakes in the offer do not bind Makzy’s.
Each offer includes at least the following information:

• Total price including taxes;
• Any applicable shipping costs;
• How and when the contract is concluded;
• Whether the right of withdrawal applies;
• Payment, delivery, and performance terms;
• Duration or validity period of the offer;
• How the consumer can review and correct their data before concluding the contract;
• Archiving and access to the concluded contract.

Discounts and promotions apply only during the stated validity period and cannot be retroactively applied to previous orders. Changes to promotions apply only to future orders and will be communicated in a timely manner.

Article 5 – The Agreement

The agreement is concluded when the consumer accepts the offer and meets any conditions set therein, subject to availability of products. If accepted electronically, Makzy’s will confirm receipt of acceptance promptly. Until confirmation, the consumer may withdraw from the agreement.

Makzy’s implements reasonable security measures for electronic data transmission and payment processing. Within legal limits, Makzy’s reserves the right to verify the consumer’s ability to fulfill payment obligations. Orders may be refused or subject to special conditions if justified.

At or shortly after delivery, Makzy’s will provide the consumer with the following information in writing or on a durable medium:

• Conditions and procedure for exercising the right of withdrawal, or a clear statement if excluded;
• Relevant product or service details already provided before contract conclusion;
• Contact address for complaints.

Article 6 – Right of Withdrawal

Consumers may cancel the purchase within 14 days without giving a reason. The withdrawal period starts the day after receipt of the product by the consumer or a designated representative.

During this period, the consumer must handle the item and packaging carefully and only use it as necessary to assess whether they want to keep it. If exercising the right of withdrawal, the item must be returned with all accessories and, if reasonably possible, in its original condition and packaging, with price tags connected, following the seller’s clear return instructions.

The consumer must notify Makzy’s of the withdrawal within 14 days after receiving the product.The product must then be returned within 14 days of notification, with proof of shipment if requested. Makzy’s cannot be held responsible for lost or damaged packages during the return shipment. If the consumer does not notify Makzy’s or return the product within these periods, the sale is final.

Article 7 – Costs of Withdrawal

If the consumer exercises their right of withdrawal, they bear only the direct costs of returning the product. Makzy’s will refund payments within 10 days after receiving the returned product. Refunds will be made via the original payment method. Consumers are liable for any diminished value of the product resulting from improper handling beyond what is necessary to inspect it.

Article 8 – Exclusion of the Right of Withdrawal

The entrepreneur may exclude the consumer’s right of withdrawal for certain products as described in paragraphs 2 and 3. Such exclusion applies only if the entrepreneur has clearly stated this in the offer or at least in a timely manner before the conclusion of the agreement.

The right of withdrawal is excluded for the following categories of products due to their nature:

• Custom or personalized products made specifically for the consumer (e.g., clothing with custom names, logos, or prints). These products cannot be returned unless they are defective or damaged upon delivery.
• Hygiene products and undergarments, for reasons of hygiene and safety.
• Sale or discounted items, unless these are faulty or damaged.
• Gift cards, which are non-refundable and cannot be returned.

Article 9 – Pricing

All prices stated in the offer are fixed and valid during the specified validity period, except in cases where changes in statutory VAT rates or other legally imposed taxes and duties require adjustments. Unless otherwise stated, all prices are quoted in Euros and include all applicable taxes and government-imposed charges, including VAT.

Shipping and handling costs, if applicable, are not included in the product prices and will be clearly indicated separately during the ordering process.

Makzy’s strives to ensure that all prices are accurate. However, in the event of obvious errors, such as printing, typing, or calculation mistakes, Makzy’s reserves the right to correct these errors at any time. Makzy’s shall not be held liable for such errors and is under no obligation to honor incorrect prices. In case of an error, Makzy’s will notify the consumer as soon as possible and offer the option to confirm or cancel the order based on the corrected price.

Article 10 – Conformity and Warranty

All products delivered will conform to the agreement, the specifications stated in the offer, and reasonable consumer expectations. The consumer should inspect the product upon delivery and notify us promptly of any defects or non-conformity. The warranty does not cover damage caused by improper use, negligence, or normal wear and tear.

Article 11 – Shipping and Delivery

Delivery times are indicative and not binding; we strive to deliver within the agreed period but do not guarantee exact delivery dates. We are not liable for delays caused by shipping carriers, customs processing, or other events beyond our control. Products will be delivered to the address specified by the consumer at the time of purchase. Once the products are transferred to the carrier, title and risk of loss or damage pass to the consumer. If the consumer is absent at the time of delivery, we will follow our standard procedure for re-delivery or collection.

Article 12 – Payment

Payment must be made in full before or at the time of delivery, unless otherwise agreed. We accept payment methods as indicated at checkout. If payment is not received within the agreed term, we reserve the right to suspend delivery or cancel the order. All payments are processed securely. Any costs related to payment transactions, such as bank fees or currency conversion charges, are the responsibility of the consumer unless stated otherwise. In case of late or incomplete payment, we may charge collection costs and statutory interest in accordance with applicable law.

Article 13 – Intellectual Property Rights

All designs, artwork, prints, graphics, and related creative content featured on Makzy’s products, including but not limited to T-shirts, are the exclusive intellectual property of Makzy’s or its licensors and are fully protected by copyright, trademark, design rights, and all other applicable intellectual property laws and regulations. This includes all original works, logos, brand names, and any licensed materials.

Consumers are granted a limited, non-exclusive, non-transferable right to use the purchased products strictly for personal, non-commercial purposes only. Any reproduction, copying, distribution, public display, modification, adaptation, resale, or other commercial use of Makzy’s designs, artwork, trademarks, or related intellectual property is strictly prohibited without prior explicit written authorization from Makzy’s.

All trademarks, logos, trade names, and brand identifiers displayed on Makzy’s products or website remain the sole property of Makzy’s or their respective owners and may not be used, reproduced, or exploited in any manner without prior written permission.

Makzy’s reserves all rights not expressly granted herein and will enforce its intellectual property rights to the fullest extent permitted by law.

Article 14 – Limitation of Liability

Makzy’s is not liable for any indirect, incidental, or consequential damages arising from the use of our website, products, or services, including but not limited to loss of profit, loss of data, or loss of use.
Our liability is in all cases limited to the amount paid by the consumer for the relevant product, unless the damage is the result of intent or gross negligence on our part, or unless otherwise required by mandatory law.
We strive to ensure that all information provided on our website is accurate and up to date. However, we cannot guarantee the completeness or correctness of this information. We reserve the right to correct errors, inaccuracies, or omissions at any time.

Makzy’s is not responsible for delays or failure in performance caused by events outside our reasonable control, including but not limited to natural disasters, acts of war, cyberattacks, supplier delays, or disruptions in transportation or communication systems.

Article 15 – Complaints Procedure

At Makzy’s, we strive to provide the best products and services. If you have any complaints, please let us know so we can resolve the issue promptly.

You can submit your complaint by email to: connect@makzys.com. We will acknowledge receipt of your complaint within 5 business days. We aim to resolve complaints within 14 days. If more time is needed, we will inform you of the expected timeline.

Article 16 – Disputes

Dutch law exclusively applies to agreements between the entrepreneur and the consumer to which these general terms and conditions apply, including cases where the consumer resides abroad.

The United Nations Convention on Contracts for the International Sale of Goods (CISG, Vienna Sales Convention) does not apply.

We reserve the right, in our sole discretion, to update, change, or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. We will notify you of any material changes to these Terms in accordance with applicable law, and such changes will be effective on the date specified in the notice. Your continued use of or access to the Services following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
